GROLIER PRIVACY NOTICE
Dear Valued Customers and Independent Contractors,
With reference to the Personal Data Protection Act 2010 (herein after referred to as ‘the Act’) that was enforced on 15th November 2013, Grolier (Malaysia) Sdn. Bhd. (“GROLIER”) is ensuring that we are compliant with the Act. Pursuant to the requirements of the Act, we are now issuing this Privacy Notice to all our Customers and Independent Contractors (i.e. Sales Representatives, Collectors, Recovery Officers), detailing the management of your Personal Data that were previously collected.
CONSENT BY CUSTOMERS
By signing the sales contract confirming your purchase of GROLIER’s products, you agreed and consented to GROLIER to collect, use, process, store, and disclose your Personal Data for purposes related to your purchase as set out in this Privacy Notice.
CONSENT BY INDEPENDENT CONTRACTORS (Sales Representatives, Collectors, Recovery Officers)
By providing your Personal Data and signing the Agreement with GROLIER, you acknowledge that you have been informed of the purposes for which your Personal Data is collected and processed, and you hereby give your consent to GROLIER to collect, use, process, store, and disclose your Personal Data for purposes as set out in this Privacy Notice.
COLLECTION OF PERSONAL DATA
(A) CUSTOMERS
GROLIER will process your Personal Data as listed, but not limited to below, which have been provided by you through a sales contract to GROLIER for the furtherance of your purchase with our direct selling transactions.
- Name, NRIC number, age, TIN number
- Job details (designation, company)
- Contact information, home and office addresses, home and office phone numbers, mobile phone number, email address
- Images of the house/office as a proof of delivery
- Spouse’s details such as name, NRIC number, mobile and office numbers, Employer’s name, position, length of service and nearest relative’s mobile and office contact number
- Bank card/Bank account details
(B) INDEPENDENT CONTRACTORS
(Sales Representatives, Collectors, Recovery Officers)
GROLIER will process your Personal Data as listed, including but not limited to below, which have been provided by you through an application form to Grolier for the purpose related to your agreement as an Independent Contractor.
- Name, NRIC number, age, sex, marital status, nationality, TIN number
- Driving license number
- Contact information, home address, home & mobile numbers, email address
- Date & place of birth
- Bank name, bank account number and bank account details
- Academic qualifications
- Employment history
- Emergency contact information
- Referees’ contact information
collectively above (A) and (B) hereinafter referred to as “Personal Data”
PURPOSES AND USAGE OF PERSONAL DATA
(A) CUSTOMERS
GROLIER will use and/or process the Personal Data for, amongst others, the following purposes:
- Inform of company’s new promotions
- Process of payments and continuous updates till payment is settled
- Communicate with customers and independent contractors
- Maintain a customer database and customer service related processes
- Market surveys and trend analysis
- Investigate complaints and suspected suspicious transactions
- Spouse’s details to serve as an alternative point of contact
- Nearest relative’s contact numbers to serve as an additional backup contact point in the event the customer changes their contact number but failed to inform Grolier
(B) INDEPENDENT CONTRACTORS
(Sales Representatives, Collectors, Recovery Officers)
GROLIER will use and/or process the Personal Data for, amongst others, the following purposes:
- Compliance with applicable statutory, regulatory, and tax requirements
- Verification of your identity and driving license
- Assessing your suitability, eligibility and qualifications to be engaged as an Independent Contractor
- Preparing and administering agreement and contractual relationship between you and Grolier
- Preparing any payments or disbursements of commission earned
DISCLOSURE OF YOUR PERSONAL DATA
(A) CUSTOMERS
GROLIER will keep your Personal Data confidential and will not be disclosed for any purpose other than the purpose for which the personal data was collected at the time of collection. However, on certain circumstances, your Personal Data may be disclosed to any other parties as below:
- Our sales agents and their superior whom you’ve made your purchase with for GROLIER products
- In circumstances where delay or default in payment has occurred, it will be disclosed to our appointed lawyers, debt collection agencies and credit reporting agencies (CTOS)
- Any person who is under a duty of confidentiality who has undertaken to keep such data confidential
(B) INDEPENDENT CONTRACTORS
(Sales Representatives, Collectors, Recovery Officers)
GROLIER will keep your Personal Data confidential and will not be disclosed for any purpose other than the purpose for which the personal data was collected at the time of collection. However, on certain circumstances, your Personal Data may be disclosed to any other parties as below:
- Tax Authorities – for statutory and tax requirements
- Financial Institution – for the purpose of processing commissions, or other payments due to you
- Legal advisers/Regulators – in the event of any claims, disputes, investigations, or legal proceedings
- Any person bound by a duty of confidentiality and who has agreed to keep such data confidential
We may also disclose the Personal Data if required to do so by law or in good faith.
SECURITY
GROLIER shall keep and process your Personal Data in a secure manner, where practicable, in accordance with the applicable laws and regulations to prevent the unauthorized or unlawful processing of your Personal Data including loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction.
Please note that by you continuing to use or purchase GROLIER’s products, you are accepting and consenting to your Personal Data being processed by GROLIER for the purpose as set out above.
RETENTION OF DATA
GROLIER shall take all reasonable steps to ensure that all Personal Data is destroyed or permanently deleted if it is no longer required for the purpose for which it was to be processed.
ACCESS AND CORRECTION TO YOUR PERSONAL DATA
You may at any time hereafter make written inquiries and request, in writing, for access to, or correction of, your Personal Data held by us. We will make every endeavour to ensure your Personal Data is accurate and up to date. Therefore, we ask that if there are any changes to your Personal Data, you should notify us directly via registered post, email or call us as set out below:

CUSTOMER TESTIMONIAL CONSENT
1. Consent to Use Images, Photographs, Video Recordings, Audio Recordings and Testimonials
By signing the consent form, you hereby grant Grolier (Malaysia) Sdn. Bhd. (“GROLIER”), its Independent Contractors (i.e. Sales Representatives, Collectors, Recovery Officers), employees and assign the irrevocable right and permission to use your images, photographs, video recordings, audio recordings, and/or written or spoken testimonials taken of you or provided by you in connection with your experience with GROLIER and its products.
It is understood and agreed that these materials may be used for promotional, advertising or marketing purposes in various forms of media, including but not limited to:
- Company website
- Social media platforms
- Printed marketing materials (brochures, leaflets, posters, flyers)
- Television or online video ads
- Press releases and public relations materials
- Internal presentations and training
2. Voluntary Participation
It is understood that:
- Your participation is voluntary.
- You may withdraw your consent at any time by submitting a written request to dpo@grolier.com.my
- Once published, some uses (especially online or printed materials) may be difficult to retract, and GROLIER will make reasonable efforts to cease future use upon withdrawal but cannot guarantee the removal of all prior distributions.
